Clare’s Law Domestic Violence Disclosure Scheme 2014 to 2024

The Domestic Violence Disclosure Scheme (DVDS) is often called Clare’s Law, which was implemented in March 2014. Please refer to the below link, should you wish to make a request for information under Clare’s Law.
The DVDS provides procedures for disclosing information which will enable a partner to make informed choices about whether and how to take forward a relationship. There is a Right to Know process and a Right to Ask process.
Right to Know – is a process which is triggered when Police receive information or intelligence about the safety of a person and where after appropriate checks are made, the force decides that a disclosure should be made to safeguard that person.
Essex Police considers every Domestic Abuse incident that comes into the Force for whether a Clare’s Law disclosure could be applicable and whether a Right to Know application should be made.
Right to Ask – is a process, where an applicant (members of the public) can make a direct application to the Police for information about the subject.

Clare’s Law - Right to Ask Applications by Third Party 2018-2020 | Essex Police
Information regarding Gender, Age and Ethnic Origin is not held by Essex Police in what is referred to as a readily accessible format. The department responsible for dealing with these cases only records details on the spreadsheet listing the first name and surname of the Applicant, Person at Risk (if different) and Subject. To compile this information would entail manually extracting the requested data and then reviewing each application one by one in order to ascertain the Gender, Age and Ethnic Origin. To establish if information is held would, therefore, exceed the time and cost limits under the Freedom of Information Act and would qualify as the creation of data as the results cannot be processed by means of purely sorting or filtering data sources or running a database query tool. There is no requirement under the act to create data purely to answer FOI requests.

The Force Information Management Board chaired by the Deputy Chief Constable has oversight of the Force wide programme of work to improve the quality of Force data. This work has identified data quality leads in all key areas of the business including the Crime and Public Protection Command. Liaison between the Force Data Quality Team and the Crime and Public Protection Command lead for data quality will identify and resolve issues through a variety of mechanisms to ensure regular and appropriate supervisory oversight.
