In relation to offences contrary to S.1 Dangerous Dogs Act 1991 please supply the following information
1) Does Essex Police use the Interim Exemption Scheme (The Dangerous Dogs Exemption Schemes (England and Wales) Order 2015) for dogs assessed by a Dog Legislation Officer as a banned breed?
2) If Essex Police does not use the Interim Exemption Scheme why not?
3) who in Essex Police makes the decision whether a person is charged with an offence contrary to S1 Dangerous Dogs Act 1991 or the alternative civil proceedings under S4B of the Dangerous Dogs Act 1991 are used?
4) Does Essex Police have a written policy regarding use of the Interim Exemption Scheme and S4B Dangerous Dogs Act 1991

Having completed enquiries within Essex Police in respect of Section 1(1)(a), Essex Police does hold information relating to your request. Under Section 1(1)(b) the below and attached have been provided in relation to your request:

Yes – interim exemptions are considered on a case by case basis depending on circumstances.
2) If Essex Police does not use the Interim Exemption Scheme why not?

3) who in Essex Police makes the decision whether a person is charged with an offence contrary to S1 Dangerous Dogs Act 1991 or the alternative civil proceedings under S4B of the Dangerous Dogs Act 1991 are used?
CPS in respect of the offence – Dog Inspector / Dangerous Dog Manager in regards to Section 4B which will go through our legal team – the courts take decisions on the outcome on both aspects..
4) Does Essex Police have a written policy regarding use of the Interim Exemption Scheme and S4B Dangerous Dogs Act 1991
