Panel returns finding in DCC Horne misconduct proceedings

An Essex Police spokesperson said: “We note the findings of the panel. A further hearing will be held in public in due course in order that the Chief Constable, as appropriate authority, can decide on what sanction will be applied.
 
Those sanctions include management action, written warning, final written warning and do not include dismissal.
 
These events happened over two years ago, since when Essex Police has been inspected on ethical conduct and leadership by Her Majesty’s Inspectors who found that “… leaders are aware of the importance of an ethical approach and act as ethical role models.”
 
We will reflect carefully on the detailed panel findings and will of course look to ensure that any wider learning for the force is taken on board.”

This hearing involved senior police officers with decades of good conduct and brave, diligent service between them, often in extremely stressful situations. The panel has recommended management advice as the most appropriate sanction for each count proven. Dorian Lovell-Pank QC, panel chair, said Mr Horne has brought strength and honour to each force in which he has served.

A further hearing will be held where the appropriate authority, Chief Constable Stephen Kavanagh, will determine what sanctions will be applied.
 
The findings of the panel are:

Allegation One – The panel found that part b, DCC Horne called Supt Maleary a **** was proven at a level of misconduct with the rest unproven

Allegation Two – DCC Horne pushed Chief Supt O’Malley causing him to fall on to a desk. The panel found this to be proven at a level of misconduct

Allegation Three – DCC Horne threw a rubber stress ball at Chief Supt O’Malley hitting him in the throat and leaving a red mark. The panel found this to be proven at a level of misconduct.
