For clarity and to help you locate the information, I am asking for charges under the following law, Section 66B, sexual offences Act:

(1) A person (A) commits an offence if—
(a) A intentionally shares a photograph or film which shows, or appears to show, another person (B) in an intimate state,
(b) B does not consent to the sharing of the photograph or film, and
(c) A does not reasonably believe that B consents.

Please note the following:
- The data was obtained from the crime universe, based on offence codes 088/15 (Sharing intimate photograph or film to cause alarm, distress or humiliation, or for sexual gratification/ threaten to share intimate photograph or film) and 175/08 (Share photograph or film of person in intimate state without consent).
- These offence codes cover Section 66B of the Sexual Offences Act.
- The incident summary for each offence was manually reviewed in order to identify offences where 'deepfake' images were used.
- Part one of this request relates to offences committed between 01/02/2024 and 30/06/2024 inclusive.
- Part two of this request relates to offences disposed between 01/02/2024 and 30/06/2024 inclusive.

Reasoning – Essex Police are unable to provide a comprehensive data report to meet this request as the data is not available in a readily extractable format, nor is it held on a central log.
In respect of Questions 3 & 6, Essex Police are unable to provide the number of convictions in relation to the offences within this request, as this information is held by HM Courts & Tribunals Services (HMCTS) who hold such data. This request would entail manually extracting the requested data, manually searching each relevant case / crime record, cross referring on the investigation file as the process of referring to the CPS will be contained within each file and then the Police National Computer (PNC) to establish the outcome and whether the case resulted in a prosecution.
In respect of Questions 2 & 4, all of the incidents have been reported and classified under Home Office Counting Rules for Recorded Crime with the Full Offence Code Title ‘Disclose or threats to disclose private sexual photographs/film with intent to cause distress’. Therefore, it is not possible to determine which incidents specifically involve/include threats to share private sexual photographs or films, or indeed appear to show someone in an intimate state.
Each crime / incident file would need to be examined and a manual review of each to determine the nature or precise detail of the offence, which may be held in free text investigation notes, in order to respond to this request, this would take an estimated 60 minutes per case file – this would take considerable resource to achieve and, therefore, is regarded as excessive and would exceed the time and cost limits under the Act.
To establish if information is held would, therefore, as set out above, exceed the time and cost limits under the FOIA and would qualify as the creation of data as the results cannot be processed by means of purely sorting or filtering data sources or running a database query tool. There is no requirement under the act to create data purely to answer FOI requests.
